There is no physical or forensic evidence connecting our brother to any aspect of the murder. The entire case rests on the testimony of a convicted felon who had just been released from prison and admitted to being under the influence of multiple drugs at the time of the alleged offense. That same witness also acknowledged lying to multiple law enforcement agencies during the investigation. In addition, he was convicted of tampering with evidence in this case, and was the only one who benefited from this case.
Baby Brother Wrongfully Accused
Our brother's conviction hinges on a single, unreliable witness. In a case with no eyewitnesses, no confession, and no independent forensic proof, the State’s entire theory rests on the convicted felon — a man with a history of changing stories, admitted truth-stretching, and multiple inconsistencies. DNA and gun evidence either excludes our brother but the witness (a convicted felon) carried the only with blood evidence present tied to the case and admitted carrying during the alleged offense. Crucially, shell casing handling and post-event investigations fail to corroborate his version. With reasonable doubt intact at every turn, the defense argues that no proof along with newly discovered evidence highlights alternate explanations. Under Texas law, that means Not Guilty.
This case fails on several grounds:
1. The Case Depends Almost Entirely on a convicted witness.
No eyewitness to the shooting
No recorded confession
No forensic evidence proving that our brother fired a gun
The murder weapon theory comes only from the witness.
2. The Witness Is Documented as Unreliable in the Record
He initially denied anything happened
He later admitted he did not tell the truth at first
He gave multiple inconsistent statements, which the State itself acknowledged
His story changed over time, adding details later
3. Physical Evidence Does Not Corroborate the witness
DNA evidence excludes the witness and includes an unknown contributor
The only gun with blood evidence was the .380, which the witness admitted carrying
The alleged .22 murder weapon is tied to the case only by the witness
The shell casing appeared later, after the witness left the ranch, and was handled improperly
4. No Proof Eliminates Reasonable Doubt
The evidence does not exclude:
Another shooter
An accidental death
False accusation motivated by fear, drugs, or self-preservation
Evidence contamination or misinterpretation
The bottom line is that our brother's legal innocence is established because the State’s case relies on one inconsistent witness, the physical evidence does not support that witness, and reasonable doubt remains at every critical point.
