Our Brother Declaration

The following document is our brother's sworn declaration, asserting his innocence in the Magan King murder. He is serving 90 years at the Connally Unit and emphasizes that he did not kill Magan and that he did not testify at trial because his lawyers believed there was no forensic link to him and that Stephen Jilek was untruthful.  Our brother asserts that the trial information was misconstrued or false. Here are the key points of his declaration.

  • When Brandi Desrosiers visited the ranch with Stephen Jilek about a month before the murder, Jilek, recently released from prison, stayed at the ranch to help with work after our brother May 2016 shoulder surgery.

  • The .380 handgun at issue was brought by Brandi and given to Jilek.

  • Our brother denies owning or carrying that weapon and disputes Jilek’s testimony about gate codes and other actions.

  • Our brother did not request or use drugs on the night in question; he cites a November 4, 2016, drug test showing he was clean, noting this was not presented at trial.

  • In his declaration, he has requested DNA testing of bunkhouse blood swabs to determine Magan’s blood presence, arguing that if Magan’s DNA is found there, it would undermine Jilek’s testimony that he did not see or touch Magan’s body.

  • He also explained that his left lateral bicep surgery limited his ability to perform heavy work, and that Jilek’s duties included operating equipment near the burn site where Magan’s body was found.

  • He recounts October 30–31, 2016, events involving Magan, Brandi, and Jilek, including alleged sexual activity with Brandi and subsequent alibi details. He disputes several aspects of Jilek’s testimony, including claims about tire damage, Magan’s phone, and gate access.

  • The declaration also contains an extensive narrative cross-examination of Jilek’s credibility, asserting misrepresentations and inconsistencies in trial testimony.

Overall, the document is a focused assertion of innocence with a plan to challenge trial testimony through DNA testing and the presentation of alternative explanations for the events surrounding Magan King’s death. It emphasizes the unreliability of Stephen Jilek's testimony and the absence of direct forensic links to our brother.
